These Terms & Conditions govern all bookings, inquiries, services, and travel arrangements provided by Terra Sur Travels (“we,” “us,” or “our”). By requesting information, confirming a booking, or participating in any travel arrangement organized by Terra Sur Travels, the traveler (“you” or “the client”) acknowledges that they have read, understood, and accepted these Terms & Conditions.
Terra Sur Travels operates as a travel planner and coordinator, working with independent third-party suppliers such as airlines, hotels, lodges, transportation providers, guides, and activity operators.
We do not own, operate, or control airlines, vessels, vehicles, accommodations, or activity providers. Our responsibility is limited to the planning, coordination, and reservation of travel services as agreed upon with the client.
A booking is considered confirmed only after:
Written confirmation is issued by Terra Sur Travels, and
Any required deposit or full payment has been received.
Verbal agreements, inquiries, or draft itineraries do not constitute a confirmed booking.
All prices are quoted based on:
Current supplier rates,
Exchange rates at the time of quotation,
Availability at the time of booking.
Prices may change prior to confirmation due to factors beyond our control, including but not limited to:
Exchange rate fluctuations,
Fuel surcharges,
Government fees or taxes,
Supplier price adjustments.
Unless otherwise stated, payments are due according to the schedule provided at the time of booking. Failure to meet payment deadlines may result in cancellation of services without further notice.
Any request to modify a confirmed itinerary (dates, services, destinations, accommodations, activities) is subject to:
Availability,
Supplier approval,
Additional costs and change fees.
Terra Sur Travels cannot guarantee that changes will be possible once a booking has been confirmed. Any costs incurred as a result of changes requested by the traveler are the traveler’s responsibility.
We reserve the right to make reasonable changes to itineraries when necessary due to:
Weather conditions,
Safety concerns,
Operational constraints,
Supplier availability,
Government regulations,
Force majeure events.
In such cases, we will make reasonable efforts to provide suitable alternatives. No refunds or compensation are guaranteed for itinerary adjustments that are necessary for safety, legal compliance, or operational reasons.
Cancellation policies vary depending on suppliers and services booked. These policies will be communicated prior to confirmation.
In general:
Deposits are non-refundable unless explicitly stated otherwise.
Late cancellations may result in partial or total loss of payment.
No-shows are non-refundable.
Refunds, if applicable, are subject to supplier policies and may take time to process.
We reserve the right to cancel travel arrangements if:
Required payments are not received,
The traveler fails to comply with these Terms & Conditions,
The traveler engages in behavior that is unsafe, illegal, or disruptive,
Travel becomes impractical or unsafe due to circumstances beyond our control.
In such cases, refunds, if any, will be handled according to supplier policies.
Terra Sur Travels is not responsible for:
Flight delays, cancellations, schedule changes,
Missed connections,
Airline overbooking,
Lost or delayed baggage.
Airline tickets are governed by the airline’s own terms and conditions. Travelers are responsible for verifying flight details, baggage allowances, and travel documents.
The traveler is solely responsible for:
Valid passports,
Visas,
Vaccinations,
Entry and exit requirements,
Health documentation.
Failure to comply with entry requirements may result in denied boarding or entry, for which Terra Sur Travels bears no responsibility.
Many travel experiences in South and Latin America involve:
High altitudes,
Remote locations,
Limited medical facilities,
Physical activity.
Travelers are responsible for ensuring they are medically and physically fit to participate. We strongly recommend comprehensive travel insurance covering medical emergencies, evacuation, and trip interruption.
Travel involves inherent risks. By participating in travel arrangements organized by Terra Sur Travels, travelers acknowledge and accept these risks, including but not limited to:
Accidents,
Illness,
Weather conditions,
Wildlife encounters,
Infrastructure limitations.
Terra Sur Travels is not liable for injury, loss, damage, or inconvenience resulting from such risks.
Terra Sur Travels does not support, facilitate, or engage in any illegal activities.
This includes, but is not limited to:
Drug use, possession, or trafficking,
Illegal wildlife interaction or trafficking,
Exploitation of people, animals, or natural resources,
Any activity prohibited by local, national, or international law.
Travelers engaging in illegal behavior may have their travel arrangements terminated immediately, without refund.
Terra Sur Travels does not offer, promote, arrange, or endorse Ayahuasca ceremonies or the use of psychoactive substances.
We do not believe that the majority of operators offering such experiences meet adequate standards of safety, medical supervision, or ethical responsibility. Any participation in such activities is undertaken independently by the traveler and is entirely outside the scope of our services.
Travelers are expected to:
Respect local laws and customs,
Follow environmental regulations,
Comply with conservation rules,
Respect local communities and cultures.
Failure to do so may result in termination of services without refund.
To the fullest extent permitted by law, Terra Sur Travels shall not be liable for:
Indirect or consequential damages,
Loss of enjoyment,
Acts or omissions of third-party suppliers,
Events beyond our control.
Our maximum liability, if any, shall not exceed the amount paid directly to Terra Sur Travels for services rendered.
Terra Sur Travels is not liable for failure to perform services due to events beyond reasonable control, including but not limited to:
Natural disasters,
Political unrest,
Pandemics,
Government actions,
Strikes,
Acts of God.
These Terms & Conditions are governed by the laws of the Republic of Ecuador. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Ecuador.
By booking or participating in any travel arrangement organized by Terra Sur Travels, the traveler confirms acceptance of these Terms & Conditions in full.
Travelers residing in the European Union, the United States, Canada, or Australia acknowledge that Terra Sur Travels operates as an inbound travel planner and coordinator based in South America, and that travel services are provided primarily through independent third-party suppliers operating under local laws and regulations.
While consumer protection standards in the traveler’s home country may differ, all services arranged by Terra Sur Travels are governed by the laws, regulations, and operational realities of the destination country or countries visited.
By booking with Terra Sur Travels, travelers expressly acknowledge and agree to the following:
Unless explicitly stated in writing, Terra Sur Travels does not operate as an organizer of “package travel” within the meaning of the EU Package Travel Directive (EU) 2015/2302, nor as a tour operator under equivalent legislation in the United States, Canada, or Australia.
Terra Sur Travels acts as a planner and intermediary, coordinating individual services provided by independent suppliers. Legal protections, refund rights, and guarantees applicable to package tours or fully bonded tour operators in the traveler’s home country may therefore not apply.
Travel in South and Latin America may involve standards of infrastructure, safety, medical access, transportation, and accommodation that differ from those commonly expected in Europe, North America, or Australia.
By booking with Terra Sur Travels, travelers confirm that they understand and accept these differences and agree that such conditions do not constitute a breach of contract or grounds for compensation.
Terra Sur Travels does not guarantee specific outcomes, experiences, weather conditions, wildlife sightings, comfort levels, or subjective satisfaction.
Descriptions, images, and itineraries are provided in good faith but are illustrative rather than contractual. Variations are inherent to travel and do not entitle the traveler to refunds or compensation.
Travelers from Europe, the United States, Canada, and Australia are strongly advised to obtain comprehensive travel insurance that includes, at a minimum:
Medical expenses and emergency evacuation
Trip cancellation and interruption
Travel delays and missed connections
Baggage loss or delay
Failure to obtain adequate insurance is done at the traveler’s own risk.
Any complaints must be communicated to Terra Sur Travels in writing as soon as reasonably possible during the trip, allowing an opportunity to address the issue where feasible.
Claims for compensation or damages based on consumer protection standards of the traveler’s home country that exceed the limitations set forth in these Terms & Conditions are expressly excluded, to the extent permitted by law.
Travelers agree that Terra Sur Travels shall not be held to standards of liability, guarantees, or remedies applicable under consumer protection laws of jurisdictions outside Ecuador, except where such application is mandatory and cannot be lawfully excluded.
This summary explains how Terra Sur Travels works and what travelers can realistically expect. It is written to be clear and transparent. The full Terms & Conditions remain legally binding.
We plan and coordinate trips in South and Latin America using independent local partners such as hotels, guides, transport providers, and airlines.
We are not an airline, hotel owner, transport company, or tour operator that controls every service directly. Our role is to plan carefully, coordinate responsibly, and advise honestly.
A trip is only confirmed once:
you receive written confirmation from us, and
required payments are received.
Prices are based on current availability, exchange rates, and supplier costs. Until a booking is confirmed, prices and availability can change.
If you request changes after booking:
changes depend on availability,
additional costs or fees may apply,
not all changes are possible.
If you cancel, refunds depend on supplier policies. Deposits are usually non-refundable, and late cancellations often result in partial or full loss of payment.
If we or suppliers must adjust plans (due to weather, safety, logistics, regulations, or force majeure), we will look for reasonable alternatives, but refunds or compensation are not guaranteed.
We do not control airlines.
We are not responsible for:
flight delays or cancellations,
missed connections,
overbooking,
lost or delayed luggage.
Air travel is governed by airline rules. Travelers must check schedules, baggage rules, and ticket conditions directly.
Travelers are responsible for:
valid passports and visas,
entry and exit requirements,
vaccinations and health documentation.
Many trips involve high altitude, remote areas, or limited medical facilities. You are responsible for ensuring you are physically and medically fit to travel.
We strongly recommend comprehensive travel insurance, including medical evacuation and trip interruption.
All travel involves risk. This includes weather, infrastructure limitations, wildlife, illness, and unforeseen events.
By traveling with us, you acknowledge and accept these risks. We cannot eliminate them, and we do not guarantee perfect conditions.
We do not support or tolerate illegal activities.
This includes:
drug use, possession, or trafficking,
illegal wildlife interaction,
exploitation of people, animals, or natural resources,
any activity that violates local or international law.
If a traveler engages in illegal or unsafe behavior, we may terminate services immediately, without refund.
We do not offer, arrange, promote, or endorse Ayahuasca ceremonies or psychoactive substances.
We believe most operators offering such experiences do not meet adequate safety, medical, or ethical standards. Any participation in such activities is done independently and entirely outside our services.
Travelers are expected to:
respect local communities and cultures,
follow environmental and conservation rules,
comply with regulations in protected areas.
Failure to do so may result in services being terminated without refund.
Travel in South and Latin America may differ from standards in your home country. Infrastructure, comfort levels, medical access, and logistics can vary.
We do not automatically provide protections associated with EU Package Travel rules or equivalent laws unless explicitly stated in writing.
All travel arrangements are governed by Ecuadorian law, and disputes are handled under Ecuadorian jurisdiction.
We plan trips carefully, but we don’t control everything

Not every trip or destination is right for everyone
Sometimes the responsible choice is to adjust plans—or not travel at all
Clear expectations make better journeys for everyone
We believe good travel planning includes honesty, limits, and judgment. If something doesn’t make sense for your expectations, safety, or timing, we will say so.
That’s not a weakness — it’s part of responsible travel.
While Terra Sur Travels strives to provide accurate and useful information, we cannot guarantee that all content—especially regarding entry requirements, health recommendations, or travel regulations—is up to date at the time of your travel. Governmental rules, visa requirements, and health advisories can change without notice. We strongly recommend that all travelers consult official governmental websites, embassy advisories, and certified health institutions in their home countries prior to departure.
Terra Sur Travels assumes no responsibility or liability for any disruptions, denied boarding, quarantine, or other complications arising from outdated or incomplete information on this site.
